These terms govern your use of merkabacreatives.org. By using the site you accept them. If you don't, please don't use it.

These terms cover the website only. Paid work is governed by the separate written agreement we sign with you. Where the two conflict, that agreement wins.

What this site is

An informational site describing services offered by Merkaba Creatives, with a voice agent for booking a consultation. Nothing here is an offer to form a contract, and nothing here is professional, legal, financial or tax advice.

Using the site

You agree not to:

Use the site unlawfully, or to harass, defraud or impersonate anyone
Attempt to gain unauthorised access to the site, its systems, or the services behind it
Scrape, crawl or harvest content by automated means beyond normal search indexing
Interfere with the site's operation, including by overloading the voice agent
Reverse engineer or copy the site's design, code or content for a competing offering

The voice agent

The audit conversation is handled by an AI system, not a person. Please bear in mind:

It can be wrong. Treat anything it says as a starting point, not advice you should act on.
Scope, pricing or timelines it mentions are indicative only and are not binding on us.
Don't share passwords, payment details, health information or anything else confidential with it.
Your audio is processed by a third party, as described in our Privacy Policy.

We may limit or withdraw the agent at any time.

Intellectual property

The site's content, design, branding, code, video and the Merkaba Creatives name and mark belong to us or our licensors and are protected by copyright and trademark law. You may view and share links to the site. You may not reproduce, republish or create derivative works from it without written permission.

If you send us ideas or feedback, you grant us a non-exclusive, royalty-free licence to use them without obligation or compensation.

Third-party links and services

We link to other sites and load resources from third parties. We don't control them and aren't responsible for their content, availability or practices. Following an external link is at your own risk.

Availability

The site is provided on an "as is" and "as available" basis. We don't promise it will be uninterrupted, error-free or secure, and we may change or discontinue any part of it without notice.

Disclaimers and limits of liability

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, Merkaba Creatives is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars (US$100).

Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold harmless Merkaba Creatives and its personnel from any claim or demand, including reasonable legal fees, arising out of your misuse of the site or your breach of these terms.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.

Changes

We may update these terms. The date at the top shows when they last changed, and continuing to use the site afterwards means you accept the revision.
